Recent Appellate Decision Upholds Verdict Against Tara Walsh in Battery and Domestic Violence Case

The 1st District Court of Appeal has upheld a jury verdict against Tara Walsh, who was sued by Stephen Russell for battery, intentional infliction of emotional distress, and domestic violence.

The court's analysis indicates that the evidence strongly supports Russell's battery claim. Russell's testimony about becoming severely ill and seeking toxicology reports after visits from Walsh played a crucial role.

Walsh's admission to drugging Russell's wine (see Evidence page) without his knowledge or consent contributed to the court's conclusion that battery had occurred.
On the intentional infliction of emotional distress claim, the court found that Walsh's conduct, particularly her act of drugging Russell's wine without his knowledge, met the criteria for this charge. Russell's testimony about the panic and distress he experienced upon feeling the effects of the drugging was instrumental in the jury's finding.
In the case of domestic violence, the court clarified that the elements were satisfied. Walsh's actions, which induced panic in Russell, resulted in injuries that meet the legal definition of abuse.
